As part of the implementation of the High Orientations of His Majesty King Mohammed VI, may God glorify and assist Him, regarding the national energy sector and in line with the national energy strategy, the National Electricity Regulatory Authority was established under Law No. 48-15 relating to the regulation of the electricity sector and the creation of the National Electricity Regulatory Authority, promulgated by Dahir No. 1-16-60 of 17 Shaaban 1437 (May 24, 2016). In order to enact the aforementioned law No. 48-15, the National Electricity Regulatory Authority’s (ANRE) Board members have been appointed and the first board meeting will be held in October 2020 to validate a set of documents and decisions including the authority’s strategic roadmap 2021-2025. To operate, ANRE’s board consists of three bodies: The Board, the President and the Dispute Resolution Committee. Accordingly, and on the occasion of the Council of Ministers, chaired by His Majesty King Mohammed VI, may God glorify and assist Him, Mr. Abdellatif BARDACH was appointed President of ANRE on August 20, 2018. Besides its president, ANRE’s board is composed of: – Three members appointed by decree, the first one for his expertise in legal matters, the second one for his expertise in financial matters and the third one for his expertise in the field of energy; – Three members appointed by the President of the House of Representatives and selected for their expertise in legal, economic or energy matters; – Three members designated by the President of the House of Councilors and selected for their expertise in legal, economic or energy matters. In this context, the Official Bulletin n°6907 released on August 10, 2020 included the decree n°2-20-564 of 23 rejeb 1441 (March 18, 2020) appointing the first three board members of ANRE, the decisions of the President of the House of Representatives n°19/0453, No. 19/0454 and No. 19/0455 of 28 Rabii II 1441 (December 25, 2019) appointing the second three board members of ANRE and the decision of the President of the Chamber of Councilors No. 19/200 of 22 Rabii II 1441 (December 25, 2019) appointing the last three board members of ANRE. Therefore, ANRE’s board is composed, in addition to its president Mr. Abdellatif BARDACH, of the following members:
1. Members appointed by decree: – Mr. Driss CHATER; – Mr. Mohamed MAHROUG; – Mr. Mohamed BERNANNOU. 2. Members appointed by decision of the President of the House of Representatives: – Mr. Mustapha AJJAB; – Mr. Ahmed El Mehdi MEZOUARI; – Mr. Srhir BAALI. 3. Members appointed by decision of the President of the House of Councilors: – Mr. Ahmed TOUHAMI; – Mr. Mohammed BADDIR; – Mr. Khalid HENNIOUI. Regarding the Dispute Settlement Committee, the Supreme Council of Judicial Power appointed on December 5, 2018 Mr. Essaid SAADAOUI, President of Chamber at the Court of Cassation as the President of this Committee, in accordance with the provisions of the above-mentioned law 48-15. Eventually, it should be mentioned that the mission of ANRE will be in accordance with the application of the provisions of law n°48-15 relating to the regulation of the electricity sector and the creation of the National Electricity Regulatory Authority to accompany the transformations that the renewable energy sector has undergone, in order to (i) increase its attractiveness, strengthen the confidence of donors, investors and industrial entities, (ii) ensure competition and transparency in the electricity sector, and (iii) facilitate Morocco’s integration into the Mediterranean electricity market. ANRE will also work at setting the tariff for use of the national electricity transmission grid and the tariff for use of the mediumvoltage electricity distribution networks. In addition, ANRE approves the multi-year investment program of the national electricity transmission system operator. It also approves the code of the national electricity transmission system, which sets, in a non-discriminatory manner, the technical prescriptions concerning the conditions of connection and access to the national electricity transmission system, including interconnections, as well as the rules relating to the use of the said system. On the other hand, ANRE has the power to sanction and settle disputes. Sanctions are imposed by decision of the President of ANRE with the assent of the Dispute Settlement Committee.
